2010. We live in a Heartland Homes community Castleview Estates
Kennedy Township.

The biggest investment OF YOUR LIFE welcome to our Heartland
Homes home. To us, as home owners of a newly constructed home we
closed on February 2004, we still find it difficult to wrap our
minds around our entire new home experience. We have well over 1,000
digital pictures, tons of emails and complete documentation to
validate everything we have posted. Believe it or not, we
even went as far as chiseling brick from the front of our home
towards the end of our Heartland Homes lawsuit, our Heartland Homes
trial ended in early 2009. See the photo below of our home in our

Our Heartland custom home builder tells us that our
Wet Basement remedy will begin, email dated July 2004 and We
will Continue to Work Towards A Solution, email dated January 2005
(see emails below), yet in our opinion we never see that
solution. The reason we hand chisel brick from the front of
our home is to see if we can see what is behind our brick.
Here is what our Heartland Homes home looks like today in 2010. Not
sure when we will move and put our Heartland Homes for sale.

Over 5+ years of what we consider water problems with a brand new
home, there has to be a reason, right? Even during the Heartland
Homes complaint we filed with the BBB (Better Business Bureau),
Heartland Homes makes a few attempts to correct the water coming
into our foundation, see photos under our 2005 and 2006 timeline
section of photos further below. We continue to have water problems
as you should be able to see when you review our timeline photos
further below in 2005, 2006, 2007, 2008 minimally.

We paid a certified Structural Engineer to come to our home to
explain to us, in his professional opinion and experience what the
problem could potentially be. We even have documentation from our
custom home builder Heartland Homes, for the Andersen Windows we
have installed regarding Window Flashing. To read more about this

The condensed version is we won the verdict in our lawsuit.
Heartland Homes appealed the monies portion of our $11,700 verdict.
Having photos to document and prove we've had water problems since 3
months after closing on our home and already spending over $24,000
of our monies, why bother going any further, we filed a
discontinuance. Which simply means we still won the verdict in our
lawsuit, however we walk away with absolutely nothing, period. To

Please keep in mind as you read our details and view all of our
custom home photos, emails and documentation; we are not in the
construction industry. We are simply presenting all of the
information we have, including a sampling of the custom home photos
we took, documentation we received from our custom home builder,
actual emails we sent and received to/from Heartland Homes. We also
included the emails we sent to Marty Gillespie of Heartland Homes
shortly after we filed our Heartland Homes complaint with the Better
Business Bureau (BBB) in 2005. In June 2005 is when Marty Gillespie
came to visit our home to see about the issues we were having.

We Sent To Heartland Homes or click here...
Our home was constructed in 2003 and completed in early
2004, closed on our first Heartland Homes home February 2004. We
also have the building permit and occupancy permit to validate this
information as well. We've had to research a lot of information,
take a lot of photos, countless hours of documenting everything to
put our case together for the Better Business Bureau, Pennsylvania
State Attorney Generals Office, our Attorney for our Heartland Homes
lawsuit and now for you the public for our website(s).

As of May 21, 2010 it has been literally 6 years since
our water problems started in our Heartland Homes custom home.
May 21 2004 is when our water problems started and
the first time we notified our custom home builder Heartland
Homes
we were having water problems. We have been working to find a more
concise way to present all of our information so our site
doesn't jump around as much. Hopefully this new format will enable
folks to follow along more easily with our home experience with our
Heartland Home builder. Please know, it is not our intention to have
"GAPS" in our story. Please be sure to refer to our timeline,

In our opinion one item really stood out to us as we moved
along in our process. Please read the section Significant ITEM TO
NOTE directly below. Next small section below the Significant
ITEM TO NOTE is simply a high-level summary of our Heartland
Homes review, under the heading of our Heartland Homes Summary
Review. Please scroll further below as each year is now broken
down into some details however a lot more photos. Please see each
section below Titled for each year starting 2004,
2005, 2006, 2007, 2008,
2009 and 2010.
We would like you to focus on the actual
documents we have listed here. The actual photos or copies of
all of the documents we mention are below under the section titled
our Heartland Homes Review Summary. July 22, 2004 email from
Heartland to us, the homeowners refers to our water problem as
Wet Basement.
September 21, 2004 email from Heartland to us, the homeowners
refers to our water problem as Extreme Amount of Water.
January 21, 2005 email from Heartland to us, the home owners
states We Will Continue To Work Towards A Solution...
June 29 2005 Heartland Homes signed letter to the BBB stating
We met with Mr. Romesburg and discussed solutions for his door
and Wet Basement problems. We are currently working with Mr.
Romesburg to remedy these issues.
October 4, 2006 (after we ask the BBB to escalate our case. We
now find water in our electrical panel after trenching is performed)
Company states they are currently working with the customer to
remedy the problems with the door and Wet Basement problems. Company
seeks to make repairs, etc.
October 17, 2006 Company states they performed work on
customer's townhouse and this work was done as
a courtesy. It is stated in customer's warranty that "Damp
Spots on foundation walls do not constitute a Wet Basement.
Company further states they are not responsible for Damp Spots on
Foundation walls. etc"
November 3, 2006, 17 days later Heartland Homes response
to the PA State Attorney Generals Office is - Heartland Homes
will continue to MONITOR the situation but believes that
the remedial steps taken have ELIMINATED
the Water Staining Issue. See section
under 2006 Titled PA State Attorney Generals Office. In our
opinion you should be about to see photos showing our Water issues
after the date posted on the response.
In our opinion we go from having a Wet
Basement from 2004 into late 2006. Then October 17 2006,
BBB document from Heartland Homes now state we have Damp Spots.
Approximately 17 days later, Heartland Homes states to the
State Attorney General Office Heartland Homes will continue to
MONITOR the situation but believes that the Remedial Steps
Taken have ELIMINATED the Water Staining Issue.. Please note
under the PA State Attorney Generals Office section further
below, we have posted photos, some with newspapers showing
the actual dates after the 2006 with what we believe to be is
water.
February 2004 we close on our first
Heartland Homes home.
May 2004 our water problems start,

Letter we sent to the company that handled our Homeowners
Association at this time.
The Meritage Group Pittsburgh, PA. Because our Heartland
Homes new home community was still fairly new, there had to be a
certain percentage of homes occupied before our own board could be
elected.

Direct quote from their website About US states: "Heartland
Homes is collaborating with The Meritage Group on Providence Pointe
in Marshall Township, Castleview Estates in Kennedy Township, Sonoma
Ridge Estates in Moon Township, and Morning Grove Manor in Adams
Township. We are also excited about Cobblestone Manor in Ohio
Township."
Because our Heartland Homes new home
community was still fairly new, there had to be a certain percentage
of homes occupied before our own board could be elected. We believe
this is why The Meritage Group in Pittsburgh handled our Home owners
Association.

Around October 2006 we file a Heartland Homes complaint with
the PA State Attorney Generals office.

continued to have water problems well after this letter was written
from our custom home builder to the Attorney Generals office. All 3

December 2007 we start the process with finding an attorney
for our Heartland Homes lawsuit.
December 2008 we had a non-jury court trial.
January 2009 Judges verdict in our favor for $11,700.00**
January/ February 2009 our custom home builder Heartland
Homes files an appeal for the monies portion of our verdict. Please
keep in mind our water issues have been going on since May 2004,
almost 5 years at this point.
**Cost we spent to date (end 2009) in legal fees, deposition
fees, Structural Engineer inspection(s) and expert witness
testimony, replacing our electrical panel, cost for materials for
our BBB arbitration hearing = over $24,000.00. No outside
repairs have been done at this point.

March/April 2009 we file to discontinue our Heartland Homes
lawsuit because it has been almost 5 years of water problems
at this point. By the time we pay for repairs and what we have
already spent, we will be upside down over $40,000 -
$50,000 of our own dollars. Keep in mind we were told via
emails we have posted above and below - our Wet Basement remedy
was to begin, We will continue to work Towards A Solution.
Marty Gillespie of Heartland Homes did visit our home and assign
Craig as our point person for our issues, etc. See details under
each year timeline below.
Honestly we never documented anything until we
noticed our water issues were getting worse, not better and that is
in our opinion. Judge for yourself, click on each and every photo to
view the larger image. Review our custom home photos of our
Heartland Homes home. Please review the photos below, what are your
thoughts. Since we notified Heartland Homes every time we had water
problems and we were told our Wet basement remedy would begin in X
period of time, in our opinion, our water problems were getting
worse not better.
As I've mentioned above under the section SIGNIFICANT ITEM TO
NOTE - we already knew Heartland Homes warranty did NOT cover
"damp spots" on foundation walls. We knew this when we signed our
contract for our new home, well before we closed on our home. As you
can see in the emails from Heartland Homes they refer to our water
problem as Wet Basement in an email to us in 2004.

No one from Heartland Homes ever came
into our home during our 1 year warranty period to look at
the water problems we reported. We were never asked if our water
problems were resolved. The emails from Heartland
Homes validate we
were told that our Wet Basement remedy would begin in July 2004, as
well as We Will Continue To Work Towards A Solution in January 2005.

the only page we are posting. Since we sent our contact
person Donna, and Jim Rumbaugh almost an exact copy of what
we filed with the Better Business Bureau, we do not want to
duplicate this information yet again on this website so we
are only posting this single page, not a copy of everything
we sent to The Meritage Group. After we sent all of our documentation, emails and photos to the Meritage Group regarding our water problems in our Heartland Homes custom home, nothing was resolved and nothing changed. Please note The Meritage Group did not build our home, they only managed our Homeowners Association at the time and for a while afterwards. I had a few conversations with Donna and from my understanding Donna did discuss our Heartland Homes water problems with Jim Rumbaugh, the President or the owner of The Meritage Group in Pittsburgh, PA. I will not post what Donna from the Meritage Group told me during our phone conversation(s). This would be considered here say and I, Dave Romesburg have no documented proof. November 15 2005 is a photo of our
love Heartland Homes home. Photo above is 21 months, less than two years after closing on our brand new home. In our opinion we have water on the floor either from trickling down our cinder block foundation wall or from where the floor meets the block foundation. |
We are not in the construction industry, nor are we home
builders. We do know we've has water problems in our new home since
May 2004. We had a Structural Engineer come to our home prior to our
court trial. We have the building codes from 2000 and 2003.
Our water issues were never resolved, period. As you can hopefully
clearly see in some of the photos above. From 2008 on we haven't
taken many photos of our water problems because I think the 1,000+
photos we have starting in 2004 are plenty.

I was asked on the court stand if I knew what was BEHIND our brick
and at that time, I did not. Once we posted the Structural Engineer
reports below you can see what John states regarding FLASHING and
weepholes.

Behind our Brick Veneer and Vinyl Siding
During our trial when I, Dave Romesburg, was on the stand, I was asked if I knew what was behind the brick veneer front of our home. Unfortunately at the time of our Heartland Homes trial, I did not. However after our trial, when I did hand chiseling some bricks from the front of our custom built home, I was very familiar with what was installed behind our brick veneer in the areas where I removed brick. I also pulled back the vinyl siding from the side of our home to see what was installed under our vinyl siding at the side of our home. If we had to do over again, I would have removed brick veneer and our installed vinyl siding before our court trial even started. We are not in the construction industry, however
